5-2-1: DEFINITIONS:
As used in this chapter, unless the context otherwise requires:
ANIMAL CONTROL OFFICER: The appointed animal control officer of the town, his designee, temporary independent contractor or any peace officer.
ANIMAL OR ANIMALS: Horses, mules, burros, cattle, goats, sheep, cats, swine, llamas, ostriches, emus or other livestock, poultry or any other animal that is susceptible to rabies, except dogs.
AT LARGE: Any dog which is both:
   A.   Off the premises of the owner or on the property of another person without the consent of that person;
   B.   Not under the direct control and physical custody, restraint by means of leash, chain, rope or enclosure of the owner or other person responsible for the dog.
BARKING: The characteristic short, abrupt, explosive, loud, sound or noise uttered by a dog.
COLLAR: A band, chain, harness or suitable device worn around the neck of the dog to which a license may be affixed.
CONTROL OF OWNER: An owner or person responsible for the animal has immediate verbal control or actual physical control of said animal.
DANGEROUS OR VICIOUS: An animal or dog which has a propensity to attack, to cause injury or otherwise endanger the safety of human beings without provocation or which has been found to be a vicious animal by a court of competent authority, which bites, inflicts physical injury on or attacks a human being, or constitutes a physical threat to other animals.
DOG: A member of the "Canis familiaris" family.
EXCESSIVE: That which goes beyond what is proper, right, or usual; being too much or too great; immoderate; inordinate.
HEARING OFFICER: That person set forth in section 5-2-12 of this chapter.
OWNER: Any person having a right of possession or custody of a dog, or who keeps, or knowingly permits, the dog on or about any premises owned or leased by that person, for more than six (6) consecutive days.
POUND: Any establishment authorized by the town for the confinement, maintenance, safekeeping and control of dogs that come into custody of the animal control officer.
REPEATEDLY: More than three (3) times in any thirty (30) day period.
TOWN ANIMAL ENFORCEMENT AGENT: The person responsible for the enforcement of this chapter.
UNRESTRAINED: Failure to use physical restraint, force or authority in preventing, suppressing, controlling, or bringing under control.
VACCINATION: An antirabies vaccination using a type of vaccine approved by the state veterinarian. (2006 Code; amd. Ord. O 09-04, 6-2-2009; Ord. O 09-05, 6-2-2009)
