The permit holder shall pay to the Town an annual rental fee, in addition to the contractual Franchise Fee, for the use and occupancy of the space within a Town conduit and/or beneath said public street, alley, sidewalk, or other public ground or facilities ("Public Rights-of-Way") occupied by such use, in the following amounts:

Nothing herein shall be construed to require a holder of a cable system franchise (i) to pay any fee other than its cable system franchise fee to occupy space beneath the Public Rights-of-Way or (ii) to occupy City or another party's conduit to the extent that the cable system franchisee can install its own plant outside of the conduit, or in a separate conduit, at the same time that a trench is opened.
