All construction shall be performed in accordance with plans and specifications approved by the Mayor and working foreman/public works supervisor and shall be in compliance with all applicable laws, rules and regulations. All land surfaces and all pavement shall be restored to their original condition after the work is completed on each segment of the project. "As built" drawings shall be furnished to the Town by the permit holder to show the precise locations, depths, and the nature of all materials installed in accordance with the permit. The Town shall have the right at any time when in its judgment it becomes necessary or advisable to require a change of location of said cable as a matter of safety, or on account of a change of grade, resurfacing, repair, reconstruction of any street, alley, sidewalk, or other public ground or the construction of any structure thereon, or for any other reason, all of which shall be done at the cost and expense of the permittee in a good and workmanlike manner.
In addition to the foregoing, the following rules shall also be followed at all times throughout the construction project:
(a) Permit Display: A copy of the construction permit and approved plans shall be maintained at the construction site and made available for inspection by Town officials at all times when construction or installation work is occurring.
(b) Safety: All applicable safety standards, rules and requirements related to the work and the installation, operation, maintenance, and use of the fiber optic cable, coaxial cable, communication cable, power lines or other facility shall be followed at all times.
(c) Traffic and Pedestrian Safety: Traffic and pedestrian safety shall be considered before commencing any construction within a public right of way. The permit holder shall be required to coordinate all work that could affect pedestrian or vehicular traffic with the working foreman/public works supervisor and police department to establish a plan for traffic control.
(d) Lane Closures: Any and all lane closures shall require the prior consent of the police department. Except in the event of an emergency, lane closures on Town streets will be limited to after 8:30 a.m. and before 3:00 p.m. When the services of a police officer are required, the permit holder shall be billed by the Town of Star City the hourly rate of the officer(s) salary.
(e) Covering of Holes: All bore pits, potholes, trenches or any other holes shall be filled in or covered daily unless other safety procedures are approved by the working foreman/public works supervisor.
(f) Erosion and Storm Water Controls: Erosion control measures (e.g., silt fence) and advance warning signs, markers, cones and barricades must be in place before work begins. The permit holder shall be responsible for storm water management erosion control that complies with Town ordinances, and state and federal guidelines.
(g) No Obstruction: All work shall be performed and maintained in such a manner as not to obstruct or hinder travel or public safety on such public ways or obstruct use by the Town or other users of the public right of way.
(h) Appearance: The permit holder shall comply with all instructions of the Town on all issues of aesthetics and appearance.
(i) Private Property: The permit holder shall be required to avoid any impact on private property, landscaping or trees. The Town may review and monitor any installations and require any disruption or damage to private property caused by such installation to be immediately restored at the contractor's expense to at least as good a condition as existed before the installation, if not better.
(j) Installation of all manholes and handholes as appropriate: Placement of all manholes and/or handholes must be approved in advance by the working foreman/public works supervisor. Manholes and handholes will not be located in sidewalks unless approved by the foreman/public works supervisor.
(k) Line Locations: Permit holders working in rights-of-ways shall be required to obtain line locations from all affected utilities or others with facilities in the rights-of-ways prior to any excavation.
(l) Working Hours: Except in emergencies or approved in advance by the Mayor, the working hours in rights-of-ways shall be as follows:
(1) Residential Areas - Monday through Friday between the hours of 7:00 a.m. and 7:00 p.m.
(2) Commercial (Non-Residential) Areas - Monday through Friday between one (1) hour after sunrise and until sunset Monday through Friday.
Non-emergency work that needs to be performed outside these hours must be approved in advance by the Mayor. Any non-emergency work performed on Saturday must be approved forty-eight (48) hours in advance by the Mayor. Directional boring is permitted only Monday through Friday from 7:00 a.m. to 7:00 p.m. unless approved in advance. No work will be done except for emergencies on Sundays or the Town's holidays.
(m) Signage: Legible information signs stating the name, address and telephone number of the permit holder and the contractor(s) doing the work shall be placed at the location where construction is to occur at least twenty-four (24) hours prior to the beginning of work in the rights-of-way and shall continue to be posted at the location during the entire time the work is occurring. An information sign will be posted at both ends of the construction area unless other posting arrangements are approved or required by the working foreman/public works supervisor.
(n) Parking of Vehicles: No vehicles may be parked, nor may any equipment or materials be stored, on the roadway without express prior approval by the police department except as may be required during actual installation operations and while all required traffic control is present and in place.
