The Communications Act of 1934, as amended by the Telecommunication Act of 1996, being 47 U.S.C. §§ 201 et seq., grants the Federal Communications Commission jurisdiction over many aspects of telecommunications services. The city’s regulation of towers and WTFs in the city will not have the effect of prohibiting any person from providing wireless telecommunications services in violation of the Act.
