9.04.030: NOISE:
   A.   It shall be unlawful for any person to make, create, continue or cause to be made, created or continued, any loud or unnecessary noise, which noise disturbs or injures others within the limits of the city, or which adversely affects the comfort, health, peace or safety of others within the limits of the city between the hours of twelve o'clock (12:00) midnight and six o'clock (6:00) A.M., or at any other time so as to unreasonably interfere with the peace, comfort, and repose of owners or possessors of real property and the public at large except in cases where urgent necessity in the interest of public health and safety has been demonstrated. Any noise as defined below that is plainly audible at a distance of seventy five feet (75') from the property line of any property where the same is located, or at a distance of seventy five feet (75') from any vehicle or person in a public right of way or street shall be deemed a violation of this section.
   B.   The following acts are declared to constitute the making of frequent, repetitive, or continuous, loud and unnecessary noises in violation of this section, but the enumeration contained in this subsection shall not be deemed to be exclusive.
      1.   The creation of frequent, repetitive, or continuous sounds in connection with the starting, operation, repair, rebuilding, or testing of any motor vehicle, motorcycle, off highway vehicle, or internal combustion engine within a residential district, so as to unreasonably disturb or interfere with the peace, comfort, and repose of owners or possessors of real property. This also includes the use of motor vehicles without mufflers. The use of engine brakes on commercial semitractor trucks, commonly known as "jake brakes" or "pac brakes", is also prohibited within the city.
      2.   The creation of frequent, repetitive or continuous sounds which emanate from any building, structure, apartment, condominium or construction site, which unreasonably interfere with the peace, comfort, and repose of owners or possessors of real property, such as sounds from construction equipment, audio equipment, musical instruments, band sessions, sound amplifiers, or social gatherings.
      3.   Sound from motor vehicle sound systems, such as tape players, radios, and compact disc players.
      4.   Sound from home or business audio equipment, such as tape players, radios, television, compact disc players or live bands.
      5.   The foregoing provisions shall not apply to regularly scheduled and city approved events at parks, streets, parking lots, or halls, such as public address systems for baseball games or park concerts, or street fairs and dances. (Ord. 173, 10-11-2006)
