§ 53.26 APPEAL OF NOTICE OF VIOLATION.
   Any person receiving a notice of violation may appeal the determination of the Storm Water Administrator or his/her designee. The notice of appeal must be received within 30 days from the date the notice of violation. Failure to file a timely appeal shall constitute acceptance of the determination that a violation exists. There is a $100 fee to file an appeal, which is due upon filing of appeal. This fee will be returned if the resident wins the appeal, or it will be applied to the civil penalty if the appeal is denied. Hearing on the appeal before the Storm Water Advisory Committee shall take place within 45 days from the date of receipt of the notice of appeal. The decision of the Storm Water Advisory Committee shall be final. Appeals from the Board of Adjustment decision shall be appealed to the Union County Superior Court within 30 days from the date of the decision.
