§ 53.07 DISCHARGE PROHIBITIONS.
   (A)   Prohibited substances. No person shall throw, drain, or otherwise discharge, cause or allow others under its jurisdiction to discharge or dispose of non-storm water, either directly or indirectly, to the MS4, waters of the state, or upon the land, pollutants in a manner or amount that is likely to reach the MS4 or waters of the state except as described below in § 53.09, or as permitted by a NPDES permit. Prohibited substances include, but are not limited to:
      (1)   Oil and grease of petroleum or synthetic hydrocarbon origin;
      (2)   Fats, oils, and grease of plant or animal origin;
      (3)   Anti-freeze, parts cleaner, and other motor equipment fluids;
      (4)   Chemicals, paints, paint wash water, pesticides, herbicides, fertilizers, and other household or industrial chemical and hazardous wastes;
      (5)   Wash water, waste water, vehicle wash water (except from individual residential car washing), heated water, chlorinated swimming pool water, and soaps/detergents;
      (6)   Wash water from concrete trucks, concrete, and floor mop water;
      (7)   Garbage, litter, leaves, grass clippings, other yard waste, and any other solid waste materials, including animal matter, animal waste, and food waste;
      (8)   Contaminated washdown or drainage from dumpster drains;
      (9)   Sediment/silt pollution originating from excessive erosion rates on a construction site or sediment pollution entering a municipal storm sewer that causes a water quality violation as determined by the North Carolina Department of Environment and Natural Resources (NCDENR); and
      (10)   Any other discarded or abandoned substances or waste materials.
   (B)   Prohibited discharges. Prohibited discharges include, but are not limited to:
      (1)   Wastewater lines such as those from washing machines, sanitary sewers or septic systems;
      (2)   Commercial wash water cleaning vehicles, steam cleaning or equipment;
      (3)   Flushing water such as that from industrial operations, floor drains or overflowing septic systems; and
      (4)   Pipes or drains carrying wastewater or wash water from a building, operation or property.
   (C)   Prohibited connections. No person shall install, maintain or use any connection to the MS4 or waters of the state for the discharge of non-storm water or shall cause non-storm water to be discharged or conveyed through a connection to the storm water system or waters of the state unless the discharge is a permitted discharge listed in § 53.08 or is permitted by a NPDES permit. Prohibited connections include, but are not limited to:
      (1)   The construction, use, maintenance or continued existence of illicit connections to the storm drain system is prohibited.
      (2)   This prohibition expressly includes, without limitation, illicit connections made in the past, regardless of whether the connection was permissible under law or practices applicable or prevailing at the time of connection.
      (3)   A person is considered to be in violation of this chapter if the person connects a line conveying sewage to the MS4, or allows such a connection to continue.
      (4)   Improper connections in violation of this chapter must be disconnected and redirected, if necessary, to an approved onsite wastewater management system or the sanitary sewer system upon approval of the Town of Stallings Storm Water Administrator or his/her designee.
      (5)   Any drain or conveyance that has not been documented in plans, maps, or equivalent, and which may be connected to the storm sewer system, shall be located by the owner or occupant of that property upon receipt of written notice of violation from the Storm Water Administrator or his/her designee, requiring that such locating be completed. Such notice will specify a reasonable time period within the location of the drain or conveyance is to be determined, that the drain or conveyance be identified as storm water, sanitary sewer or other, and that the outfall location or point of connection to the storm sewer system, sanitary sewer system or other discharge point be identified. Results of these investigations are to be documented and provided to the Storm Water Administrator or his/her designee.
