1703.06 DEMOLITION FEE; BOND.
   For the demolition of any accessory building, or residential or commercial structure the fee shall be in accordance with Section 1703.02. Any permit to demolish any building or structure shall provide that such work shall be completed within the time specified on the permit, that all rubbish, waste materials and substances, debris, dirt and other litter shall be disposed of or removed from the premises and that the premises be cleared thereof.
   To secure compliance with this provision, a bond or certified check in an amount to be specified by the Building Official of no less than five hundred dollars ($500.00) or greater than five thousand dollars ($5,000) shall be required of the person requesting the permit.
   In determining the amount of the bond or certified check, the following shall be considered:
   (a)   Location of demolition.
   (b)   Type of building or structure.
   (c)   All other pertinent facts.
   After notification is made that the demolition is complete and upon certification by inspection by the Building Official that all requirements of the permit have been met, the bond or certified check shall be returned to the permit holder. However, should the holder of the permit fail to comply with the provisions of the permit, City Council, upon recommendation by the Building Official , may order the bond forfeited or the certified check cashed and shall direct and order the premises be cleared as required and specified by the permit, and, further, charge the permit holder the cost thereof of all required work to satisfy the requirements of the permit. Such costs shall be deducted from the forfeited bond or proceeds from the cashiers check. Any remaining monies, if any exist, shall be returned to the permit holder. Should the cost of performing the work as required by the permit exceed the forfeited bond or proceeds from the cashiers check, the permit owner shall be invoiced for the balance due. The City may, at its option, take any and all legal means available including but not limited to the filing of a lien on the property to secure payment of the balance due.
