§ 153.078 MINING, SAND AND GRAVEL EXTRACTION.
   (A)   Mining defined. The extraction of sand, gravel, rock, soil or other material from the land in the amount of 400 cubic yards or more and the removal from the site without processing shall be mining. Persons shall be permitted to mine in all zoning districts only upon issuance of a conditional use permit following a public hearing.
   (B)   Application for permit. Application for the permit shall include a land rehabilitation plan for a finished grade which shall not adversely affect the surrounding land or future development of the site on which the mining is conducted; an approved route for trucks hauling to and from the site; and adequate safeguards and protection against danger to life and property.
   (C)   Setback for mining. Production or processing shall not be conducted closer than 75 feet to the boundary of adjoining property. Excavating shall not be done closer than 150 feet to the public right-of-way, except in order to reduce the elevation thereof in conformity to the existing platted street, road or highway.
   (D)   Length of permit. Conditional use permits shall expire at the end of 3 years, at which time a re-application shall be made.
