14-9-4: HOMEOWNERS' ASSOCIATION RESPONSIBILITIES:
Where required to be established, a homeowners' association as defined by this title is responsible for enforcement of private covenants and restrictions within a subdivision, condominium, or other specified development. The association must be established and approved as a condition of plat or development approval and is responsible for the cost and maintenance of all private streets, common open space, landscape areas (which may include those within cul-de-sac islands, around identification signs and within required transition yards), stormwater facilities, and other private facilities within a development that are not dedicated to the public.
