9-3-1: TRAFFIC SIGNS AND SIGNALS:
   (A)   The council shall, by resolution, determine and designate the character or type of all official traffic signs and signals.
Subject to this determination, the chief of police is hereby authorized, and as to those signs and signals required hereunder, it shall be his duty to place and maintain, or cause to be placed and maintained, all official traffic signs and signals. All signs and signals required hereunder for a particular purpose shall so far as practicable be uniform as to type and location throughout the city.
   (B)   No provision of this title for which signs are required shall be enforceable against an alleged violator, if, at the time and place of the alleged violation, the sign herein required is not in proper position and sufficiently legible to be seen by an ordinarily observant person. (1972 Code)
