8-1-21: SIDEWALK AND OUTDOOR DINING PERMITS:
Subject to the provisions of this section, businesses desiring to provide outdoor dining facilities for their customers in the 100 and 200 blocks of East and West St. Paul Street can obtain a permit from the Spring Valley city council upon compliance with the following conditions:
   (A)   Sidewalk dining permits shall only be issued for business establishments serving food in the 100 and 200 blocks of East and West St. Paul Street in the city of Spring Valley.
   (B)   Outdoor dining shall only be allowed in front of the business establishment requesting a permit and shall only be allowed subject to the conditions contained in this section.
   (C)   Before a permit for outdoor dining is approved by the Spring Valley city council, the business requesting the outdoor dining permit must submit an application to the city of Spring Valley and the application must contain, at a minimum, the following information:
      1.   The address where the outdoor dining will be located;
      2.   The outdoor dining furniture (tables and chairs) must be of sufficient design and quality so as to harmonize and improve the aesthetic appearance of the 100 and 200 blocks of East and West St. Paul Street (plastic outdoor furniture or furniture not designed for outdoor uses will not be permitted) and a photograph and description of the outdoor dining furniture should be included with the application;
      3.   A site plan depicting the location of the outdoor dining tables must be submitted which establishes that the location of the outdoor dining tables will be in compliance with the special design elements adopted by the Illinois department of transportation for sidewalk construction and compliance with the Americans with disabilities act; and
      4.   Proof of insurance including a certificate of insurance evidencing the existence of a general liability insurance policy issued to the applicant with minimum per person liability limits of not less than five hundred thousand dollars ($500,000.00) and minimum aggregate liability limits of not less than one million dollars ($1,000,000.00).
   (D)   Any permits issued to an applicant pursuant to this section will be limited to outdoor dining during the time period from ten o'clock (10:00) A.M. to ten o'clock (10:00) P.M. from April 1 to November 1 of each year.
   (E)   No alcoholic beverages may be served or consumed in the outdoor dining area.
   (F)   The applicant must provide sufficient trash receptacles for refuse and smoking materials or in the alternative the applicant will be required to remove any trash in the outdoor dining area and dispose of the trash as part of the applicant's business.
   (G)   Any applicant requesting a permit for outdoor dining must remove all furniture and receptacles used for outdoor dining after any measurable snowfall.
   (H)   Any applicant requesting a permit for outdoor dining shall pay a fifty dollar ($50.00) annual fee for the outdoor dining permit and the outdoor dining permit must be renewed on March 1 of each year and each applicant must pay an additional fifty dollar ($50.00) yearly fee upon the issuance of a renewal permit.
   (I)   The city of Spring Valley reserves the right to rescind any outdoor dining permits issued pursuant to this section, if the applicant violates any of the provisions of this section or if the applicant fails to promptly dispose of trash or any other unconsumed food left by patrons using the outdoor dining facilities.
