7-1-10: RATES:
There shall be and there are hereby established rates and charges for the use of and for the service supplied by the combined waterworks and sewerage system of the city, based upon water consumed as shown by the water meters, as follows: (Ord. 750, 8-19-1991, eff. retroactive to 6-1-1991)
   (A)   Water Charge Per Monthly Billing Period: Effective retroactive to August 1, 2004, for each user of the water service of the combined system within the corporate limits, the monthly charge based upon the amount of water consumed as shown by the water meters shall be as follows:
      1.   A minimum charge of sixteen dollars fifteen cents ($16.15) per month which shall apply regardless of whether any water is used during the billing period.
 
For 0 - 999 gallons of usage
$16.15 (minimum charge) plus $2.45 for the water used between 0 to 999 gallons of usage
For all usage in excess of 999 gallons
$16.15 (minimum charge) plus $2.45 for the water used between 0 to 999 gallons of usage plus $2.45 per 1,000 gallons of water used in excess of 999 gallons of usage
 
      2.   In calculating bills for users of the Spring Valley water system, all meter readings will be rounded to the nearest one thousand (1,000) gallons of usage as shown on the records maintained by the Spring Valley city clerk's office. (Ord. 1145, 9-7-2004)
      3.   The sewer charges shall increase three percent (3%) in 2010 and the sewer and water charges shall increase three percent (3%) in 2012. Thereafter, there shall be an annual increase of three percent (3%) in sewer and water charges. (Ord. 1424, 7-20-2009)
      4.   Commencing with the bills sent to each user on October 1, 2015, there shall be an annual increase of two percent (2%) in sewer and water charges. Commencing with the bills sent to each user of the system on February 1, 2016, and continuing annually on each February 1 thereafter there shall be an annual increase of five percent (5%) in sewer and water charges.    (B)   Sewer User Charge Per Monthly Billing Period: For each user of the sewer service of the combined system within the corporate limits, the monthly charge shall be as follows:
      1.   A minimum charge of thirteen dollars ($13.00) per month which shall apply regardless of whether any sewer is used during the billing period.
 
For 0 - 999 gallons of usage
$13.00 (minimum charge)
For all usage in excess of 999 gallons
$13.00 (minimum charge) plus $2.92 per 1,000 gallons of sewer usage used in excess of 999 gallons of usage
 
A surcharge, in addition to the above charges, will be applied to all users whose waste discharges exceed the average concentration for BOD, and "suspended solids" as defined in the sewer use ordinance of this title.
      2.   In calculating the bills for users of the Spring Valley sewer system, all meter readings will be rounded to the nearest one thousand (1,000) gallons of usage as shown on the records maintained by the Spring Valley city clerk's office.
      3.   The sewer charges shall increase three percent (3%) in 2010 and the sewer and water charges shall increase three percent (3%) in 2012. Thereafter, there shall be an annual increase of three percent (3%) in sewer and water charges. (Ord. 1424, 7-20-2009)
   (C)   Users Outside The Corporate Limits: The following subsections shall set forth the procedures for providing water service and sewer service to potential users outside the corporate limits of the city of Spring Valley. The provisions set forth in subsections (C)2 through (C)6 of this section shall apply to applications for water service and sewer service received by the city of Spring Valley after September 1, 2000. The provisions set forth in subsection (C)1 of this section shall apply to all recipients of water and/or sewer services from the city of Spring Valley after November 1, 2006.
      1.   Beginning November 1, 2006, and continuing until October 31, 2008, the charge for water service to users located outside the corporate limits of the city of Spring Valley shall be two and one-half (2.5) times the rate for water service described herein and the charge for sewer service to users located outside the corporate limits of the city of Spring Valley shall be two and one-half (2.5) times the rate for sewer service described herein. Beginning November 1, 2008, and continuing thereafter the charge for water service to users located outside the corporate limits of the city of Spring Valley shall be three (3) times the rate for water service described herein and the charge for sewer service to users located outside the corporate limits of the city of Spring Valley shall be three (3) times the rate for sewer service described herein.       2.   Any applicant for water service or sewer service outside of the corporate limits of the city of Spring Valley shall, as a condition of said request for service, agree to enter into an annexation agreement with the city of Spring Valley which will provide for automatic annexation of the applicant's property at such time as the property shall become contiguous to the corporate limits of the city of Spring Valley. If the applicant's property is contiguous at the time of application, the applicant shall be required to annex said property into the corporate limits of the city of Spring Valley as a condition for receiving water and sewer service from the city of Spring Valley.
      3.   It shall be the responsibility of any applicant seeking water and sewer service to noncontiguous property located outside the corporate limits of the city of Spring Valley to prove to the satisfaction of the Spring Valley city council that the applicant has made reasonable efforts to try to convince any intervening property owners to annex their property into the corporate limits of the city of Spring Valley so as to provide contiguity between the applicant's property and the corporate limits of the city of Spring Valley.
      4.   It shall be the responsibility of the applicant to bear the cost of extending water and sanitary sewer service to the applicant's property unless the applicant and the city of Spring Valley agree by a properly executed annexation agreement and a properly executed annexation ordinance to make other arrangements acceptable to the city of Spring Valley and the applicant.
      5.   No applicant requesting water or sanitary sewer service from the city of Spring Valley shall be allowed to subdivide their property after receiving water or sewer service from the city of Spring Valley unless annexed or the applicant and the city of Spring Valley agree in an annexation agreement and ordinance approving the annexation agreement for other provisions regarding subdivision of property.
      6.   The Spring Valley city council reserves the right to waive or modify any of the recommendations and provisions set forth in this subsection (C) by an affirmative vote of two-thirds (2/3) of the aldermen of the city of Spring Valley. (Ord. 1002, 10-16-2000)
   (D)   Separate User: Each individual apartment, multiple home and/or trailer shall be considered as a separate user under this chapter. (Ord., 2-3-1986)
   (E)   Minimum Rates For Meter Sizes In Excess Of One Inch: Effective retroactive to August 1, 2004, the following minimum rates shall be applicable to meters in excess of one inch (1") size:

For all usage in excess of the amount of allowed gallons per month, for the particular meter size, there shall be an additional charge of two dollars forty five cents ($2.45) per one thousand (1,000) gallons of water used in excess of the monthly allowed gallons. (Ord. 1145, 9-7-2004)
   (F)   Water Service Adequacy: The adequacy of the water service charge shall be reviewed, not less often than annually, by certified public accountants for the city in their annual audit report. The water service charge shall be revised periodically to reflect a change in local capital costs or OM&R costs.
   (G)   Rates And Service Charges To Be Made Available: The method for computation of rates and service charges established for user charges in this section shall be made available to a user within seven (7) days of receipt of a written request for such. Any disagreement over the method used or in the computations thereof shall be remedied by the water and sewer committee within fifteen (15) days after notification of a formal written appeal outlining the discrepancies.
