5-21-1: LICENSE REQUIRED:
   (A)   The owner of a video gaming terminal shall obtain a license from the city for each such device operated within the city of Spring Valley.
   (B)   It shall be lawful for video gaming consistent with the state of Illinois ordinance to occur within the confines of the municipality.
   (C)   It shall be unlawful for any person or entity to deliver video gaming terminals or to operate video gaming terminals within the city for the use by any person for any purpose unless a license has been obtained and the license fee has been paid for each such machine for the current year of operation.
   (D)   The application for license shall be filed with the city clerk and shall contain the following information:
      1.   The name, address, age and birth of the owner of the video gaming terminal; the name, address and date of birth of the owner of the establishment where the video gaming terminal shall be located.
      2.   The place where the video gaming terminal is to be displayed or operated and the business conducted at that location.
      3.   A description of the video gaming terminal to be covered by the license, including model number and serial number.
      4.   Evidence that appropriate licenses and authorities have been issued by the Illinois gaming board or other necessary authorities to the owner of the video gaming terminal and to the owner of the establishment.
      5.   The annual fee for the license shall be twenty five dollars ($25.00) per machine. There is also a five dollar ($5.00) per year terminal license required. The annual fee shall be nonrefundable and shall be paid prior to the installation of each terminal. Licenses shall be renewable on January 1 the next year following issuance and on January 1 each year thereafter.
      6.   The license required by the state and the municipalities shall be prominently displayed next to the video gaming terminal.
      7.   The mayor, at any time, may terminate any license issued under this chapter upon five (5) business days' notice of a violation of any provision of this chapter by the owner of the video gaming terminal or the owner of the establishment. After a hearing presided over by the mayor, the mayor may order the revocation of the license upon a finding that the violation has occurred. The license shall thereupon be terminated immediately.
