3-10-7: COMMERCIAL OR INDUSTRIAL CONSTRUCTION:
   (A)   All new commercial or industrial construction must include, as part of the application for a building permit, design plans certified by a licensed architect and/or professional engineer as appropriate indicating that the commercial or industrial construction complies with all applicable building codes adopted by the city of Spring Valley.
   (B)   In addition to the inspections required by this chapter for any new residential construction, all new commercial and industrial construction in the city of Spring Valley will be subject to the same minimum number of inspections as required for residential construction and, if deemed necessary by the city engineer for the city of Spring Valley, additional inspections to ensure compliance with the architectural plans submitted to the city of Spring Valley as part of the building permit application. Additionally, all certifications required by this chapter from the general contractor and the subcontractors for residential construction shall be required from the general contractor and subcontractors for all new commercial and industrial construction.    (C)   For new commercial or industrial construction, the owner, developer, general contractor, or construction manager applying for the building permit shall pay in addition to permit fees and other fees that may be charged, a fee of six hundred dollars ($600.00) for the building inspections required by this chapter for new commercial or industrial construction.
   (D)   The owner, developer, general contractor, or construction manager applying for the building permit for new commercial or industrial construction shall pay the city of Spring Valley the cost of reviewing the architectural plans for the project. An estimated plan review fee based on: 1) one percent (1%) of the project construction cost for the first fifty thousand dollars ($50,000.00) of construction costs; 2) three-fourths of one percent (0.75%) of the next two hundred thousand dollars ($200,000.00) of project construction costs between fifty thousand one dollars ($50,001.00) and two hundred fifty thousand dollars ($250,000.00); and 3) one-half of one percent (0.5%) of project construction costs over two hundred fifty thousand dollars ($250,000.00) shall be paid at the time the developer requests a permit application or requests a plan commission hearing whichever occurs first and shall be placed by the city clerk into an escrow account to cover plan review costs. Upon completion of review, the city engineer shall present a summary of charges to the city and at which time funds shall be withdrawn from the escrow account and placed in the general account of the city for payment of plan review charges.
Any additional fees shall be paid by the owner, developer, general contractor or construction manager before a certificate of occupancy may be issued. If the owner, developer, general contractor, or construction manager fails or refuses to pay the review charges incurred for plan review, the city of Spring Valley shall deny a request for a certificate of occupancy upon completion of construction until the fees are paid in full.
