(A) Whenever the Common Council shall deem it necessary to construct, repair, or rebuild any sidewalk, curb, or gutter in the city it shall pass on the first reading a resolution declaring the necessity of complying therefor and setting forth a description of the proposed improvement and a description of the lots or parcels of ground abutting said improvement.
(B) Said resolution must be posted in a public place and published in the official city newspaper for two consecutive issues, stating the resolution in full and setting forth the time and place of the next regular meeting of the Common Council.
(C) If prior to the next regular meeting of the Common Council there is filed with the Municipal Finance Officer by the owners of more than 75% in frontage of the property abutting said improvement then no proceedings shall be had under such resolution, provided, however, if heretofor constructed, or the sidewalk to be constructed, connects with sidewalks already built and constructed, then the Common Council, by majority vote, may order such sidewalk to be repaired or rebuilt, or order the construction of the sidewalk connecting with the sidewalks already built and constructed, and may disregard any such protest filed against said improvement.
