It shall be the duty of the Municipal Police, Animal Control Officer, or his designee, to capture, secure, and remove in a humane manner to a shelter arranged for by the Municipality any animal violating any of the provisions of this Article. The animals so impounded shall be treated in a humane manner and shall be provided with a sufficient supply of food and fresh water each day. Each impounded animal shall be kept and maintained at the pound for a period of not less than five (5) days. Notice of impoundment of all animals shall be made to the owner if the owner is known. Any animal may be reclaimed by its owner during the period of impoundment by payment to the City Clerk or the impounding authority, the actual costs associated with the impoundment as determined by the impound facility. The owner shall then be required to comply with the licensing and rabies vaccination requirements within seventy-two (72) hours after release. If the animal is not claimed at the end of five (5) days, the approved Animal Control Authority may dispose of the animal in accordance with the applicable rules and regulations pertaining to the same; provided, that if, in the judgment of the approved Animal Control Authority, a suitable home can be found for any such animal, the said animal shall be turned over to that person and the new owner shall then be required to pay all fees and meet all licensing and vaccinating requirements provided for in this Article. The Municipality shall acquire legal title to any unlicensed animal impounded in the Animal Shelter for a period longer than five (5) days. All animals shall be destroyed and buried in the summary and humane manner as prescribed by the Board of Health unless a suitable home can be found for such animal. (Ref. 17-548, 71-4408 RS Neb.)
