140.04 REQUIREMENTS FOR INSTITUTIONAL SPECIAL POLICE OFFICER LICENSE.
   An applicant for the initial issuance or renewal of an institutional special police officer license shall meet the following requirements. The determination as to whether an applicant meets all such requirements shall be within the sound discretion of the Chief of Police; all such decisions of the Chief shall be final.
   (a)   Be an American citizen or a person who has been granted permanent residency by the U.S. Immigration and Naturalization Service, and be able to speak and read the English language;
   (b)   Be twenty-one (21) or more years of age;
   (c)   Be employed directly by an institution as defined in Section 140.01(a);
   (d)   Be in sound physical condition, have good eyesight, and not subject to any infirmity, defect or disorder of mind or body which might reasonably render him or her unfit for the safe carrying out of the duties of an institutional special police officer, as determined by the Chief of Police from all reliable medical, psychological, or health information supplied by the applicant or other persons concerning the applicant's physical or mental condition. Where such facts indicate that an applicant is suffering from any such infirmity, defect or disorder of mind or body, the Chief of Police may require the applicant, at his or her expense, to be examined by a licensed physician, psychologist, or psychiatrist and to submit such physician's, psychologist's, or psychiatrist's written report of such examination to the Chief for use in determining the applicant's fitness.
   (e)   Possess a training certification from an Ohio Peace Officer's Training Council approved school indicating successful completion of the basic police school, including a satisfactory firearms range qualification score on a practical pistol course with a service firearm.
   (f)   In the case of an applicant for renewal of an institutional special police officer license, he or she shall submit with the application for renewal, a certificate issued within the previous twelve (12) months from a qualified range instructor certifying that the applicant has satisfactorily re-qualified with his service firearm.
   (g)   Shall not have been convicted of, pled guilty to, or forfeited bond for any of the following within the last twenty (20) years:
      (1)   Any offense constituting a felony;
      (2)   A misdemeanor involving public disorder, violence, theft or public indecency;
      (3)   Two (2) or more misdemeanors, other than minor misdemeanors, neither of which involve public disorder, violence, theft, or public indecency.
