(a) The Chief of the Fire Division may designate fire lanes on private property devoted to public use.
(b) Any fire lane established in accordance with subsection (a) above, shall be identified by the placement of appropriate signs and other markings.
(c) No person shall park a motor vehicle or place any other obstruction within the fire lane.
(d) For the purpose of this section only, “park” means to stop except.
(1) To avoid conflict with pedestrian or vehicular traffic;
(2) In compliance with an order of a peace officer;
(3) In compliance with a traffic control device; or
(4) For the purpose of loading or unloading passengers or property into or out of a motor vehicle while actively engaged in such activity, while the driver remains in the immediate vicinity of the motor vehicle.
(e) Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
