153.11 NONDISCRIMINATION BY CONTRACTORS.
   (a)   Affirmative Action Goals: The goals outlined in Section 153.01 are established to promote affirmative action and apply to all contractors and subcontractors participating in contracts with the City.
 
   (b)   Prohibition of Discrimination: No contractor shall discriminate against any employee or applicant for employment on the basis of race, religion, color, sex, national origin, age, handicap, ancestry, Vietnam-era or disabled veteran status, or sexual orientation. The term "treated" includes, without limitation, recruitment, compensation, selection for training, promotion, upgrading, demotion, transfer, layoff, and termination. Contractors are required to:
      (1)    Take affirmative action as mandated by law to ensure fair treatment during employment and
      (2)    Post notices in visible locations, as provided by hiring representatives, detailing this nondiscrimination clause.
   (c)   Misrepresentation of MBE or DBE Status: Any person who intentionally misrepresents ownership, control, operation, or participation in an MBE or DBE to gain contracts, subcontracts, or other benefits under this chapter shall be found guilty of theft by deception, as defined in Ohio R.C. 2913.02.
