(a) Each Assistant Chief within the Fire Division, following written notification to the Chief of the Fire Division, may elect to receive a cash payment in lieu of all or part of his paid annual holidays for five (5) consecutive calendar years within the six (6) calendar years immediately prior to service retirement eligibility. Such employees who elect to exercise this provision shall be paid for any remaining unused holidays for which he is entitled at the straight-time rate in effect at the end of the last full pay period of the relevant year. Such payment shall be made in January following the calendar year in which the holidays were unused.
(b) Each Captain within the Police Division, following written notification to the Chief of the Police Division, may elect to receive a cash payment in lieu of all or part of his paid annual holidays for five (5) consecutive calendar years within the six (6) calendar years immediately prior to service retirement eligibility. Such employees who elect to exercise this provision shall be paid for any remaining unused holidays for which he is entitled at the straight-time rate in effect at the end of the last full pay period of the relevant year. Such payment shall be made in January following the calendar year in which the holidays were unused.
