5-4-33: VIOLATIONS AND PENALTIES:
   A.    It shall be a violation of this chapter to:
      1.    Fail to comply with any provision of this chapter, that is, to do that which is described as unlawful or to violate the requirements established by this chapter;
      2.    Fail to comply with any lawful order of the animal safety officer or police officer, unless such order is lawfully stayed or reversed.
   B.    Any person who violates any provision of this chapter shall be deemed guilty of a misdemeanor and may be punished by a fine of not more than three hundred dollars ($300.00) or imprisonment. Should any person be found guilty in any court of competent jurisdiction, the court may order the animal involved to be destroyed by the animal safety officer. (Ord. 436, 3-1-1999)
      1.    At the discretion of the charging officer, a civil citation may be issued which is punishable by a civil penalty in an amount established by resolution of the City Council. (Ord. 580, 3-13-2018)
   C.    The City may undertake civil legal action in a court of competent jurisdiction to seek to enjoin conduct which violates the provisions of this chapter and/or to recover the reasonable costs of actions deemed necessary to bring about compliance herewith. (Ord. 436, 3-1-1999)
