5-3-1: CURFEW:
   A.    Age And Hour Restrictions: It shall be unlawful for any unemancipated person under the age of eighteen (18) years to assemble, congregate, loiter, or be in, on or about any public property within the corporate limits of the City, during the following times:
      1.    Nine o'clock (9:00) P.M. to five o'clock (5:00) A.M., Sunday night through Friday morning.
      2.    Nine o'clock (9:00) P.M. to five o'clock (5:00) A.M., Friday night through Sunday morning. (Ord. 596, 6-11-2019)
   B.    Exceptions: The provisions of this section shall not apply in cases where the minor is:
      1.    Accompanied by the minor's parent or guardian;
      2.    On an errand at the written direction of the minor's parent or guardian, without any unauthorized detour, delay or stop (written direction must be signed, timed and dated by the parent or guardian and must indicate the specific errand);
      3.    In a motor vehicle involved in interstate travel;
      4.    Engaged in an employment activity, or going to or returning home from an employment activity, without any unauthorized detour, delay or stop;
      5.    Involved in an emergency. For the purposes of this section an emergency shall be an unforeseen combination of circumstances or the resulting state that calls for immediate action. The term includes, but is not limited to, a fire, a natural disaster, automobile accident, or any other situation requiring immediate action to prevent serious bodily injury or loss of life;
      6.    Attending an official school, religious, recreational, or other activity supervised by adults and sponsored by the City of Spirit Lake, Lakeland School District, a civic organization, or another similar entity that takes responsibility for the minor, or going to or returning home from such activity, without any unauthorized detour, delay or stop; or
      7.    Exercising First Amendment rights protected by the United States Constitution, such as the right of free exercise of religion, freedom of speech, and the right of assembly, or going to or returning from such activity, without any unauthorized detour, delay, or stop.
   C.    Parental Responsibility: It shall be the responsibility of each parent or guardian responsible for the supervision of an unemancipated person under the age of eighteen (18) years to ensure that such a person is not at large in violation of subsection A of this section. Failure of a parent or guardian to fulfill this responsibility shall be a violation of this section.
   D.    Penalty: Any person found to be guilty of violating this section shall be guilty of committing a misdemeanor offense and shall be punished pursuant to the laws of the State of Idaho. (Ord. 480, 12-14-2004)
