11-1-13: PUBLIC SERVICE CONNECTION:
The grantee shall provide, without charge, one service outlet to each fire station, school and police station within the city, and to such other municipally owned buildings, city hall, civic center, hospitals, emergency medical services and libraries, as may be designated by the grantor; provided, however, that if it is necessary to extend grantee's trunk or feeder lines more than five hundred feet (500') solely to provide service to any such school or public building, that school or institution shall have the option of paying the grantee's direct costs for such extension in excess of five hundred feet (500'). If this option is not exercised, the grantee shall be released from the obligation to provide service to such buildings. Further, grantee shall be permitted to recover from any public or private building owner entitled to free service, the direct cost of installing more than one outlet, or concealed inside wiring, or a service outlet requiring more than two hundred fifty feet (250') of drop cable.
The grantee shall provide access to the city to all channels in the event of an emergency. The city shall be the sole determiner of what constitutes an emergency under this section.
In accordance with applicable FCC regulations, franchisee shall make available its facilities for carriage of "educational access" and "local government access" programming and will exercise due diligence and its best efforts to accommodate reasonable demands from educational interests within the city as well as the city of Spirit Lake to such requests concerning the aforementioned access programming.
