10-2-1: APPLICABILITY:
Every division of land for the purpose of sale, lease, transfer, or building development into not more than four (4) lots, tracts, or parcels within the incorporated area of Spirit Lake shall proceed in compliance with this title.
The provisions of this title shall not apply to the following:
   A.    Any division of land for the purpose of adjusting the boundary line, or the transfer of land between two (2) adjacent property owners, which does not result in the creation of any additional building site.
   B.    Any division of land made by testamentary provision, the laws for descent, or upon court order.
   C.    Any division of land made by cemetery or burial plots while used for that purpose.
   D.    Any acquisition or division of land by a public agency for public right of way purposes.
   E.    Any dedication or new public utility requirement, excluding right of way or existing road.
   F.    Any division of land made by short plat and recorded within the past five (5) years. (Ord. 427, 7-30-1998)
