§ 50.03 THROWING GARBAGE, LITTER ON PUBLIC PROPERTY.
   (A)   No person shall throw, drop, deposit or cause to be thrown, dropped or deposited on any land in the town, vacant or occupied, including specifically streets, alleys, sidewalks and other public and semi-public areas and all waters under the jurisdiction of the town, any waste, including, but not limited to, refuse, garbage, ashes, rubbish, dead animals or fish, paper, drinking cups, broken glass, tacks, brush, grass, weeds and anything injurious to health.
      (1)   If any person, while transporting, hauling or causing to be transported or hauled, such rubbish, material, earth excavation, coal or other material, shall throw, drop, deposit or cause to be thrown, dropped or deposited such rubbish or material from the body of the vehicle, in violation of the provisions of this section, that person must daily clean up and remove the rubbish or material in a manner satisfactory to the Director of Public Works.
      (2)   If any person fails to clean up and remove such rubbish and material, the Sanitation Department may clean up and remove the rubbish and material, and the town may recover the cost of the cleaning up and removal from that person.
   (B)   No person shall throw, drop or deposit any leaves, shrubs or other debris into any catch basin or manhole in the town.
   (C)   A violation of the foregoing provisions shall be punishable as a Class 3 misdemeanor pursuant to G.S. § 14-4.
