§ 30.38 LIBRARY BOARD.
   (A)   Appointment and compensation of members; vacancies. Members of the Library Board may be appointed by the Board of Commissioners, upon the recommendation of the Library Board, and shall consist of five members. The librarian will be a member ex officio. Commencing on 7-1-1986, Library Board members will be appointed on a rotating basis and, at that time, the Board of Commissioners shall appoint one new member for a five-year term to replace the member that has served on the Library Board for the longest continuous period of time. Subsequently, on July 1 each year thereafter, the Board of Commissioners shall appoint one new member for a five-year term to replace the member that has served for the longest continuous period of time. Vacancies in the Library Board shall be filled for the unexpired term by appointment of the Board of Commissioners. The members shall serve without compensation.
   (B)   Officers; adoption of bylaws; meetings. The Library Board shall appoint from its membership a Chairperson, Vice Chairperson, Secretary and Treasurer to conduct its business, and may adopt bylaws, rules and regulations governing its procedures that are not inconsistent with the county’s Library Statement of Policy and the provisions of state laws. The Library Board shall hold regular meetings quarterly and at such other times as it may deem necessary.
   (C)   Powers and duties.
      (1)   The Library Board may accept any grant, gift, bequest or donation of any personal property offered or made for library purposes, and with the approval of the Board of Commissioners, may accept any grant, gift or devise of real estate. Any gift, bequest of money or other personal property or grant or devise of real estate shall be held, used and finally disposed of in accordance with the terms or conditions under which the grant, gift or devise is made and accepted.
      (2)   The Library Board shall have no authority to enter into any contract or incur any obligation binding the Board of Commissioners, other than current obligations or contracts to be fully executed within the current fiscal year and within the budgetary limitations set by the Board of Commissioners.
   (D)   Reports. The librarian shall maintain daily records of all library activities and submit monthly reports of these activities to the Library Board, the county’s library and the Board of Commissioners of the town. At the end of the town fiscal year, the librarian shall prepare an annual report of these activities and submit it to the Library Board, the county’s library, the state’s library and the Board of Commissioners of the town.
