§ 154.175 DEFINITIONS.
   The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning.
   ALLEY. A strip or parcel of land that is publicly or privately owned, is at least 20 feet in width between property lines and is set aside for public vehicular right-of-way to adjoining properties.
   APPLICANT. Any person, partnership, association, estate, trust or any other group or combination acting as a unit, dividing or proposing to divide land so as to constitute a subdivision as defined in this section, including any authorized agent of the applicant.
   BUILDING. Includes the word structure.
   BUILDING SETBACK LINE. A line delineating the minimum distance between the property line and a building or a lot within which no building or other structure shall be placed.
   DEDICATION. A gift by the owner of a right to the use of land for a specified purpose. Because a transfer of property rights is entailed, DEDICATION must be made by written instrument, and is completed with an acceptance.
   EASEMENT. A grant or privilege extended by the property owner for the use of a strip of land without loss of ownership for specified purposes to the public, a corporation or a person.
   LOT. A parcel of land having frontage on a public street or other officially approved means of access, occupied or intended to be occupied by a principal structure or use and sufficient in size to meet the lot width, lot frontage, lot area, yard parking area and other open space provisions of this chapter and of the town zoning ordinance.
   LOT, CORNER. A lot abutting upon two or more streets at their intersection. The shortest side fronting upon a street shall be considered the front of the lot and the longest side fronting upon a street shall be considered the side of the lot.
   LOT, DOUBLE FRONTAGE. A continuous through lot which is accessible from both streets upon which it fronts.
   LOT, RECORD OF. A lot which is part of a subdivision, a plat of which has been recorded in the office of the Rutherford County Register of Deeds prior to the adoption of the ordinance from which this section derives, or a lot described by metes and bounds, the description of which has been so recorded prior to the adoption of the ordinance from which this section derives.
   LOT, THROUGH or DOUBLE FRONTAGE LOT. A lot other than a corner lot with frontage on more than one street. THROUGH LOTS abutting two streets may be referred to as DOUBLE FRONTAGE LOTS.
   MAJOR SUBDIVISION. All subdivisions shall be considered major except for those defined as minor subdivisions.
   MINOR SUBDIVISION. The division of land involving no new public or private streets or roads, right-of-way dedications, easements or utility extensions are required, where the entire tract to be subdivided is ten acres or less in size, where five or fewer lots are created by the subdivision, and all of the newly created lots conform to all town development regulations and don’t require modification or variance of any requirement of this chapter.
   MONUMENT. A column or shaft of stone, concrete, or concrete and metal, employed to designate a fixed point, buried vertically in the earth, designed for maximum permanency, employed by a surveyor to mark corners, and of a design and composition approved by the state board of registration for engineers and land surveyors.
   OFFICIAL MAPS OR PLANS. Any maps or plans officially adopted by the Board of Commissioners as a guide to the development of the town.
   OPEN SPACE. An area, land and water, generally lacking in human-made structures and reserved for enjoyment in its unaltered state.
   PLAN. Any documented and approved program of recommended action, policy, intention and the like, which sets forth goals and objectives along with criteria, standards and implementing procedures necessary for effectively guiding and controlling decisions relative to facilitating development and growth management.
   PLAT. A map or plan of a parcel of land which is to be or has been subdivided.
   STREET. A dedicated and accepted public right-of-way for vehicular traffic.
   STREET, COLLECTOR. A street designed to carry medium volumes of vehicular traffic, provide access to the major street system and collect the vehicular traffic from the intersecting minor streets.
   STREET, CUL-DE-SAC. A street designed to have one end permanently closed, the closed end terminated by a vehicular turnaround.
   STREET, MAJOR. A street designed primarily to carry heavy volumes of local vehicular traffic.
   STREET, MARGINAL ACCESS. A minor service street which parallels and is immediately adjacent to a major street or highway, and which provides access to abutting property.
   STREET, MINOR. A street, the principal purpose of which is to provide vehicular access to the property abutting it.
   SUBDIVISION. Include all divisions of a tract or parcel of land into two or more lots, building sites or other divisions when any one or more of those divisions is created, for the purpose whether immediate or future, of sale or building development, and shall include all divisions of land involving the dedication of a new street or a change in existing streets; provided, however, that the following shall not be included within this definition nor be subject to these subdivision regulations:
      (1)   The combination or recombination of portions of previously recorded lots where the total number of lots is not increased and the resultant lots are equal to or exceed the standards of the town as required by this chapter;
      (2)   The division of land into parcels greater than ten acres where no street right-of-way dedication is involved;
      (3)   The public acquisition by purchase of strips of land for the widening or opening of streets or for public transportation system corridors; and
      (4)   The division of a tract of land in single ownership whose entire area is no greater than two acres into not more than three lots, where no street right-of-way dedication is involved, and where the resultant lots are equal to or exceeds the town’s requirements, as standards by this chapter.
   SUBDIVISION ADMINISTRATOR. The Planning Director or other individual(s) authorized by the Town Manager to administer this chapter.
