§ 154.146 EFFECT OF APPEAL.
   (A)   An appeal stays all proceedings in furtherance of the action appealed, unless the administrative official from whom the appeal is taken certifies to the Board of Adjustment that, because of facts stated in the certificate, a stay would, in his or her opinion, cause imminent peril to life or property or that because the violation is transitory in nature a stay would seriously interfere with the enforcement of this chapter.
   (B)   An appeal does not stop action lawfully approved (including construction activities authorized by a building permit); only actions presumed in violation of this chapter are stayed.
