(A) Every motor vehicle operated on a street or thoroughfare in the village shall be equipped with a muffling device which shall be so constructed, placed, and operated as to muffle the sound and prevent excessive noise, report, or explosion from the exhaust or such motor vehicle. The use of open cutouts is prohibited.
(B) Any person found guilty of violating any provision of this section shall, for the first offense, be fined $5 and costs, and for each subsequent offense, be fined not to exceed $25 and costs.
