§ 50.06 REFUSE REGULATIONS FOR BUSINESS ESTABLISHMENTS.
   (A)   Business establishments in the town may receive solid waste collection service from the town for household type garbage. For the purpose of this section, home occupations shall not be considered a business establishment unless the nature or volume of garbage exceeds that allowed for residential uses.
   (B)   Business establishments shall observe the following regulations:
      (1)   Trash bins shall be approved 95-gallon rollout style containers, and shall be limited to two. Rates for this service shall be those set by the Board of Aldermen from time to time. Containers shall be screened as described in division (B)(7). In no case shall pickup exceed more than 190 gallons.
      (2)   Waste and refuse must be placed in bags, and must be contained entirely within the receptacle. Spillover litter, excess items or bags by receptacles, or any other condition declared a nuisance under § 93.21 shall be enforced accordingly as a violation of that section.
      (3)   Any business requiring service for more than 190 gallons or requiring pickup more than once a week shall provide for their own garbage collection.
      (4)   Business establishments shall privately dispose of any junked washing machines, refrigerators, water heaters and the like that are acquired. This matter shall not be accepted at the town landfill or garbage disposal area.
      (5)   The town provides a drop-off site for separated, recyclable goods at 600 Sowers Ferry Road. Site hours are from 7:00 a.m. - 3:30 p.m. Monday through Friday, and from 9:00 a.m. - 12:00 p.m. on the first and third Saturday of each month.
      (6)   Every site upon which one or more dumpsters are to be placed shall be located and constructed so as to facilitate collection and minimize any harmful effect on persons occupying the development site, neighboring properties or public rights-of-way. Those developments hereafter established that are required to provide a refuse container shall locate the container on the property it serves. Any deterioration of the ground surface around a dumpster, i.e. broken pavement, ruts, standing water, etc., must be remedied within five business days from the personal delivery of notice or ten business days from the mailing of notice to the owner of operator by the code enforcement officer. Any dumpster area that is cited for this infraction more than three times in any six-month period must have a base pad and access drive paved with concrete, asphalt or other bituminous paving.
      (7)   Dumpster screening is required for any dumpster that is visible to the public from any point along the length of the business property at the building front. Dumpsters shall be screened in accordance with the following:
         (a)   Enclosures shall be constructed of durable, weatherproof, permanent materials. All solid waste dumpsters or other large containers for external solid waste storage shall have a lid placed on the container to minimize the potential contamination of stormwater runoff;
         (b)   Screening shall consist of a solid opaque device that is at least six feet in height, or at least one foot higher than the height of the dumpster, whichever is greater, and have latching gates to provide access. Materials and color used on the exterior of said device shall be compatible and consistent with those used on the principal structure(s) on the site; and
         (c)   The site shall be paved with concrete, asphalt or other bituminous paving and shall be located abutting a driveway of sufficient width to allow access by the solid waste collection equipment. Sites and means of access shall be approved by the Town Planner.
      (8)   The town reserves the right to deny pickup of any improperly stored materials. Any business failing to provide for proper containers will be responsible for the disposal of the materials.
      (9)   Businesses having to comply with division (B)(7) shall do so by no later than July 1, 2007. All businesses must comply with all other standards of this section by no later than December 1, 2006.
      (10)   It shall be required that all shopping centers provide at least one approved trash receptacle for every 100 feet of storefront. These receptacles shall be no larger than 30 gallons each. It shall be the responsibility of the property owner to see to the removal of trash from the above-mentioned receptacles. Each receptacle must be emptied completely at least once each week.
      (11)   Businesses that cannot conform to the standards of this chapter can apply for exception. The Technical Review Committee shall review all applications for exception with regards to this chapter. Approval of the exception is at the discretion of the Technical Review Committee. Anything unresolved shall be transmitted in writing to the Sanitation Committee for review.
