§ 130.11 POSSESSION OF ALCOHOLIC BEVERAGES ON TOWN PROPERTY.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      ALCOHOLIC BEVERAGE. Alcohol, brandy, whiskey, bourbon, scotch, rum, gin, beer, malt lager, ale, porter and wine, and in addition thereto any spirituous, vinous, malt or fermented beverages, liquids and compounds, whether medicated, proprietary, patented or not, and by whatever name called, containing .5% or more alcohol by volume.
   (B)   It shall be unlawful to display, possess or consume any alcoholic beverage on any town- owned or maintained property.
   (C)   Exceptions are as follows:
      (1)   A restaurant, legally permitted to serve beer and wine, if they have tables placed outside for dining purposes. Consumption of alcoholic beverages must be within the confines of the restaurant or its outdoor dining area only.
      (2)   A public festival or special event in which a valid special event permit has been issued by the Town of Spencer in accordance with § 94.31 and only while the permit remains in good standing.
