§ 155.061 MEDICAL/INFECTIOUS WASTE INCINERATORS.
   The following specific provisions shall be met as minimum standards prior to the approval of any business engaging in “medical/infectious waste incineration”:
   (A)   The operation must be a minimum of 1,000 feet from any building used as a dwelling and/or residentially-zoned property, church, public or private school. See division (F) below;
   (B)   The operation must be a minimum of one mile from any other lot containing municipal and hazardous waste incinerators. See division (F) below;
   (C)   A medical/infectious waste incinerator used to incinerate up to 225 pounds of waste per hour must be located:
      (1)   On a lot that is no smaller than one acre in size;
      (2)   At least 100 feet from the property line; and
      (3)   At least 1/4 mile from all lots containing main use medical/infectious and pathological waste incinerators. See division (F) below;
   (D)   A medical waste incinerator used to incinerate more than 225 pounds of waste per hour must be located:
      (1)   On a lot that is no smaller than five acres in size;
      (2)   At least 200 feet from the property line; and
      (3)   At least one mile from all lots containing main use medical/infectious and pathological waste incinerators. See division (F) below;
   (E)   No outside storage is permitted in conjunction with this use; and
   (F)   Measurement of distance separation shall be measured on a straight line from property line to property line, with no consideration as to intervening structures, roads or land forms.
