§ 113.46 APPEALS.
   (A)   In a case of refusal to grant or renew a taxicab driver's permit or upon the suspension or revocation of the permit, the applicant or driver may appeal to the Town Manager. The appeal must be made within ten days following receipt of notice of the action and shall be filed with the Town Clerk.
   (B)   Upon failure of an applicant or driver to appeal within the prescribed time, the decision shall be considered final.
   (C)   During the pendency of any appeal, the driver's permit shall be immediately surrendered to the Police Department and it shall be unlawful for the appellant to drive a taxicab within the town.
   (D)   During consideration of any appeal, the Town Manager and Town Board shall limit their scope of review to findings of fact only. The Town Board's decision shall be final and conclusive. The town may attach any conditions to any decision or order which it deems appropriate.
