(A) Temporary occupancy certifications may be issued by the Building and Zoning Officer when existing violations pose no serious or immediate threat to the health or safety of an occupant and when the following conditions exist:
(1) The owner has been delayed in correcting violations necessary to the issuance of an occupancy certification but has a valid contract in writing with a qualified person for the performance of work and the furnishing of the materials to correct such violations, and such contract specifies the dates for commencement and completion of the work, or the owner provides an affidavit stipulating that the work is to be accomplished by the owner and specifying the date by which the work is to be completed;
(2) The owner or his or her agent petitions the Building and Zoning Officer in writing for a temporary waiver of compliance with prescribed housing standards or other code or ordinance violations; and
(3) If the Building and Zoning Officer finds that the delay in the correction of the violations and the plans for such correction are reasonable and the work can be undertaken and completed while the premises are occupied.
(B) The temporary occupancy certification shall expire at the time set forth herein in the temporary certification.
