§ 150.001 BUILDING AND ZONING OFFICER.
   (A)   Duties. It shall be the duty of the Building and Zoning Officer to inspect the construction and/or remodeling of all buildings within the fire limits of the city, to inspect all buildings within the city as to fire escapes and means of fire prevention, to enforce all applicable building regulations under this chapter, to enforce all zoning regulations under Chapter 155, to attend all meetings of the Planning and Zoning Commission and the Zoning Board of Adjustment and to sit as a non-voting member of said Commission and said Board, and to perform all other duties now or hereinafter provided or delegated by the provisions of this code.
   (B)   Access to buildings. For the purpose of performing his or her duties, such Building and Zoning Officer shall have the right of access to all buildings at all reasonable hours, after giving notice to the occupants of such building.
   (C)   Stop orders. Whenever any building work is being done contrary to the provisions of this code, the Building and Zoning Officer may order the work stopped by notice in writing served on any persons engaged in the doing or causing such work to be done, and any such persons shall forthwith stop such work until authorized by the Building and Zoning Officer to proceed with the work.
   (D)   Occupancy violations. Whenever any structure is being used contrary to the provisions of this code, the Building and Zoning Officer may order such use discontinued and the structure, or portion thereof, vacated by notice served on any persons causing such use to be continued. Such person shall discontinue the use within ten days after receipt of such notice or make the structure, or portion thereof, comply with the provisions of this code.
   (E)   Liability. The Building and Zoning Officer or any employees charged with the enforcement of this code, acting in good faith and without malice for the city in the discharge of his or her duties shall not thereby render himself or herself liable personally and he or she is hereby relieved from all personal liability for any damage that may accrue to persons or property as a result of any act required or by reason of any act or omission in the discharge of his or her duties. Any suit brought against the Building and Zoning Officer or other employee because of such act or omission performed by him or her in the enforcement of any provisions of this code shall be defended by the City Attorney until final termination of the proceedings.
   (F)   Cooperation of other officials. The Building and Zoning Officer may request, and shall receive so far as may be necessary in the discharge of his or her duties, the assistance and cooperation of other officials of the city.
