§ 95.132 RESTRICTIONS ON SMOKING AND ALCOHOLIC BEVERAGES.
   Permittees shall enforce the following prohibitions or restrictions.
   (A)   Smoking tobacco or using an electronic smoking device at dining is prohibited.
   (B)   Alcoholic beverages may be served with dining pursuant to a valid alcoholic beverage control license, and in accordance with state and local alcoholic beverage control laws; provided the following additional requirements are met:
      (1)   Patron entrance to and egress from the dining shall be controlled by staff of the establishment, who shall continuously monitor the dining during times alcoholic beverages are being sold or consumed;
      (2)   No alcoholic beverages may be sold or served to patrons later than 11:00 p.m.; and
      (3)   Patrons shall not be permitted to consume any beverages at the dining that were not purchased on the premises.
   (C)   Dining shall be exempt from the requirements of § 112.09 (consumption in public places), § 112.12(A) (permanent fence), § 112.12(E) (yard setbacks) and § 112.14 (entrances) applicable to outdoor alcoholic beverage service. Dining at which alcoholic beverages are served shall be subject to all other requirements of Chapter 112.
