§ 32.09 EMERGENCY RESPONSE COMMISSION.
   (A)   The Board of Commissioners of the county hereby determines that the county shall function as a Local Emergency Planning District (LEPD) in accordance with the directive of the State Emergency Response Commission, and in compliance with the Superfund Amendments and Reauthorization Act of 1986, being 42 U.S.C. 11001 et seq., adopted by executive order by the Governor of the state.
   (B)   A committee known as the County Local Emergency Planning Committee is hereby established to carry out the purposes of the law.
   (C)   The Committee shall function in conjunction with the County Civil Defense Department and their Advisory Committee.
   (D)   The members of the County Local Emergency Planning Commission will exercise the recommendations and requirements as set out in the Superfund Right-To-Know Act of 1986.
   (E)   The County Emergency Planning Commission shall be selected by the Board of Commissioners of the county.
