The following acts are allowed:
(A) All acts, as defined by I.C. 13-17-9-1, subject to the conditions of I.C. 13-17-9-3, and as amended, including EXEMPTIONS, as defined in § 90.04;
(B) Burning of clean wood, leaves, weeds, brush, stumps, and any other vegetative debris. If the brush pile is more than 125 cubic feet (for example, five feet long, five feet wide, and five feet high), the County Dispatch must be notified at (812) 649-2286 or (800) 498-7300 before igniting;
(C) Recreational or ceremonial fires that meet the following conditions.
(1) Only clean, untreated wood or charcoal shall be used. Paper products can be used for ignition purposes only.
(2) If the pile is more than 125 cubic feet (for example, five feet long, five feet wide, and five feet high), the County Dispatch must be notified at least 24 hours prior to any burning.
(3) The fire shall not be ignited more than two hours before the recreational activity is to take place, and shall be extinguished upon the conclusion of the activity.
(4) The pile to be burned shall be less than 1,000 cubic feet (for example, ten feet long, ten feet wide, and ten feet high).
(5) The fires shall not be used solely for disposal purposes.
(6) Fires shall not take place within 500 feet of any fuel storage area or pipeline.
(D) Burning of predominantly wood structures on real property, or wood remnants of the demolition of a predominantly wooden structure originally located on real property. The County Solid Waste Management District must be notified 72 hours (three days) before the planned burn; and
(E) All allowed acts and variances are subject to, and shall adhere to, the “Illegal Trash Burning Ordinance Policies and Guidelines,” as adopted by the County Solid Waste Management District Board.
