(A) A person confined to the county jail, except as provided in divisions (B) and (C) below, shall be required to make co-payments in the amount provided hereafter for each provision of any of the following services.

(B) Division (A) above does not apply to a person confined in the county jail who:
(1) Maintains a policy of insurance from a private company covering (provided, said inmate provides complete and accurate information to allow the healthcare provider to file a claim for services rendered):
(a) Medical care;
(b) Dental care;
(c) Eye care; and
(d) Other healthcare.
(2) Is willing to pay for his or her own medical care.
(C) A person confined in the county jail is not required to make the co-payments under division (A) above if:
(1) The inmate does not have funds of $5 or more in the inmate’s commissary account at the time of medical service provided;
(2) The inmate does not have funds in the inmate’s commissary account within 60 days after the service is rendered;
(3) The service is provided in an emergency;
(4) The service is provided as a result of injury in the jail; and
(5) The service is provided at the request of the Sheriff or jail commander.
(D) Only the original filling of a specific prescription shall be charged a $10 co-payment. All refills ordered when the original prescription was written shall be charged a $5 co-payment.
(E) Inmates at the county jail shall not be refused medical care because of inability to pay. Should an inmate have a $5 balance in the inmate’s commissary account, the transaction shall be carried on the books for a 60-day period. Should an inmate receive money within the 60-day period, the co-payment will be deducted from the inmate’s account. If the inmate receives no funds at the end of the 60-day period, an adjustment entry will be made to negate the medical billing transaction. Within the 60-day period if the inmate receives monies, the outstanding co-payment will be deducted prior to a commissary order being processed.
(F) Monies collected shall be deposited into the County Medical Care For Inmates Fund, and will be used for the inmate’s medical care.
