(A) General. Under the authority of, and subject to, I.C. 36-8-16 et seq., an enhanced emergency telephone system is hereby established, together with a fee system to provide for the funding of an enhanced emergency telephone system to serve the county. This fee shall be collected from the telephone service users of the county, and administered in accordance with the terms of this section.
(B) Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ENHANCED EMERGENCY TELEPHONE SYSTEM. Pursuant to I.C. 36-8-16-2, a telephone system that uses the three-digit 911 number to send automatic number identification and automatic location identification for reporting police, fire, medical, or other emergency situations.
EXCHANGE ACCESS FACILITY.
(a) Pursuant to I.C. 36-8-16-3, the access from a particular service user’s premises to a telephone system, including:
1. An access line;
2. A private branch exchange (PEX) trunk; and
3. A centrex line trunk equivalent that is provided by the service supplier.
(b) The term also includes a mobile telephone system access trunk, whether the trunk is provided by the telephone company or a radio carrier.
SERVICE SUPPLIER. Pursuant to I.C. 36-8-16-4, a person who provides exchange telephone service to a service user.
SERVICE USER. A person to whom exchange telephone system is provided.
(C) Monthly fee. A monthly fee of $2.15 per telephone access line or other exchange access facility will be collected by the service supplier to pay the lease, purchase, or maintenance of enhanced emergency telephone equipment, including necessary computer hardware, software, and data base provisioning, the rates associated with the service suppliers’ enhanced emergency telephone system network services, and the personnel expenses of the emergency telephone system.
(D) Administrative fee. Each service supplier shall be entitled to retain an administrative fee of 3% of the monthly fees collected as compensation for collection the fees.
(E) County Treasurer. All monthly fees collected, except for the 3% administrative fee, shall be remitted to the Treasurer of the county within ten days after the last day of the calendar year quarter. With the fee remittal, each service supplier shall provide a fee collection report to the Auditor of the county on a form provided by the Auditor.
(F) Fund. The County Treasurer shall deposit the remitted fees in a separate fund named the County Emergency Telephone System Fund. The County Treasurer may invest money in the fund in the same manner that other monies of the county are invested with interest earned from such investment to be deposited in that fund. Money in that fund shall be appropriated by the County Council only for the expenditures listed in division (C) above.
(G) Delinquent fee. During January of each year, each service supplier who collects the enhanced emergency telephone system fee for the county shall provide a delinquent fee report to the County Treasurer. The report shall list the name, address, and amount due for each service user who is two or more months delinquent in paying the fee.
(H) Collection. Each service supplier shall commence collecting the enhanced emergency telephone system fee from its service users within 30 days of implementation of the 911 system.
