Sec. 6-31. International property maintenance code.
    The common council hereby adopts the 2021 International Property Maintenance Code to provide standards to safeguard life or limb, health, property, and public welfare by regulating, governing, and controlling the use, occupancy, conditions, and site maintenance of all property, buildings, and structures within this jurisdiction and to provide for a just, equitable, and practicable method whereby buildings or structures, which from any cause endanger the life, limb, morals, property, safety, or welfare of the general public or their occupants, may be repaired, vacated, or demolished. A copy of the code shall be on file in the office of the city building official.
   Sec. 101.1 Title. These regulations shall be known as the International Property Maintenance Code of the City of Spearfish, hereinafter referred to as "this code".
   Sec. 107 Means of Appeal is hereby amended to read as follows: Any person directly affected by a decision of the code official or a notice or order issued under this code shall have the right to appeal to the City Council, provided that a written application for appeal is filed within the timeframe stated in the notice. An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of this code do not fully apply, or the requirements of this code are adequately satisfied by other means.
   Sec. [A] 111.2 Membership of board is hereby amended to read as follows: The Common Council shall be the Board of Appeals.
   Sec. 113.3 Failure to comply. Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be subject to administrative citations through the code enforcement process.
   Sec. 302.4 Weeds. All premises and exterior property shall be maintained free from weeds or plant growth in excess of 10 inches.
   Sec. 303 SWIMMING POOLS, SPAS AND HOT TUBS: Sec. 303.2 Enclosures are not required for above ground prefabricated swimming pools.
   Sec. 304.14 Insect screens. The period of time to require insect screens is hereby amended to be April 1 to September 30, inclusive.
   Sec. 602.3 Heat supply. The period of time to require the heating supply to maintain a minimum temperature of 68°F is hereby amended to be September 1 to April 30, inclusive.
   Sec. 602.4 Occupiable work spaces. The period of time to require the heating supply to maintain a minimum temperature of 65°F is hereby amended to be September 1 to April 30, inclusive.
