(A) Any vacancy in the governing body of the city or the office of Mayor shall be filled by a special election called for that purpose as provided by SDCL §§ 9-13-14 and 9-13-14.2. No special election may be held less than six months before the annual municipal election.
(B) If there is a vacancy from any cause in the office of the Mayor less than six months before the annual municipal election, the vacancy shall be filled by appointment by a majority vote of the members-elect of the Common Council, as soon as practicable after the vacancy occurs, to serve until the office is filled by election for the unexpired term at the next annual municipal election.
(C) If there is a vacancy from any cause on the Common Council less than six months before the annual municipal election, the vacancy shall be filled by appointment of a majority vote of the members-elect of the Common Council, as soon as practicable after the vacancy occurs, to serve until the office is filled by election for the unexpired term at the next annual municipal election. The appointment must be a person from the same ward in which the vacancy exists.
(D) Any special election shall be held according to the procedures required by SDCL §§ 9-13-14 and 9-13-14.2.
