(A) In the case of a tie vote for Mayor or a City Council position in any city municipal election, wherein those receiving tie votes are the candidates receiving the highest number of votes cast regardless whether that election is conducted by the city or held as a joint election with the county, the tie vote will be resolved by a runoff election to be held two weeks following the regular city election, or at the conclusion of any recount, whichever occurs later. Only the persons who received the tie votes in the regular election will be on the ballot of the runoff election. The person receiving the highest number of votes in the runoff election will be considered elected.
(B) This section is adopted pursuant to the provisions of SDCL § 9-13-25, and any runoff election shall be held pursuant to the provisions of SDCL § 9-13-27.1.
