(A) License required. It shall be unlawful to operate a food truck or food cart in the city without first having obtained a license as described herein.

(B) Fees and licensing procedure.
(1) The operator of all food trucks and food carts shall apply for a license on forms provided by the city’s finance office.
(2) The annual license fee shall be set by resolution of the Common Council.
(3) The annual license and fee shall not apply in the following instances:
(a) Mobile food and beverage vendors operating where a city-approved special event permit has been issued, and with authorization from the special event sponsor, and if the vendor does not operate from any city public street, city sidewalk or city park at any other time; or
(b) Mobile food and beverage vendors that operate on public or private property for a one-time event lasting three calendar days per year or less.
