(A) License and fee. No person shall operate for profit any horse-drawn carriage upon the streets, alleys and public ways of the city without a license and paying a license fee of $25.

(B) Operation. The licensee will provide short distance transportation by means of a two-horse team and carriage only upon routes approved by the city.

(C) Indemnification. It is expressly understood and agreed by and between the licensee and the city that the licensee shall save, hold and keep harmless from all loss sustained by the city on account of any suit, judgment, execution, claim or demand whatsoever resulting from licensee’s operation. The licensee shall notify the city within 15 days after it has been presented with any claim or demand, either by suit or otherwise made against the licensee. The city shall notify the licensee within 15 days after the presentation of any claim or demand either by suit or otherwise made against the city on account of licensee’s operations.

(D) Insurance. Licensee shall at all times during the term of the license obtain and maintain liability insurance whereby the city is named as an additional insured. Said insurance shall be in the minimum amount of $1,000,000 combined single limit for bodily injury or property damage. The licensee shall provide proof of insurance to the city prior to commencement of operations.

(E) Requirements of licensee. The licensee shall comply with the following terms and conditions.
(1) Licensee shall operate his or her carriage only from Memorial Day through Labor Day inclusive.
(2) Licensee shall not stand or park his or her carriage for hire except at locations approved by the city.
(3) Licensee shall use croup bags on his or her livestock and shall promptly pick up any solid waste not so contained.
(4) Licensee shall operate his or her carriage only during daylight hours.
(5) Display of any signage upon the carriage or team shall be upon the approval of the Planning and Zoning Administrator.
(6) Licensee shall comply with all federal, state and local regulations otherwise governing the operation of horse powered conveyances upon public streets and highways.
(7) Any carriage shall have adequate lights, reflectors and slow-moving vehicle signage.
