(A) Any failure by a responsible party to pay a bill issued under this subchapter within 30 calendar days of the date of billing shall be considered a default. In case of a default, the township shall impose a time price differential charge on the unpaid amount of 1% per month or fraction thereof and may commence a civil suit or take any other action permitted at law or in equity to recover the expenses of a HAZMAT emergency response.
(B) If legal action is taken to collect an amount owed under this subchapter, the township shall be entitled to recover the costs of such legal action, from the first accrual or notice of the claim through any and all appellate and post-judgment proceedings, from the responsible party, including reasonable and actual attorneys’ fees.
