§ 34.03 PERSONNEL; APPOINTMENT; COMPENSATION.
   (A)   All members of the Fire Department shall be appointed by the Commissioner of Public Health and Safety, with the advice and consent of City Council. Members of the Department shall receive compensation as may be determined by City Council. Except as provided in division (B) herein, all members of the Fire Department shall reside within the corporate limits of the city.
   (B)   The Fire Chief and members of the Department may nominate for Council approval applicants who live outside the corporate limits after a review and consideration of all relevant factors including, but not limited to:
      (1)   The place of residence of said applicant;
      (2)   The estimated response time from said residence to the City Fire Station;
      (3)   The experience and training of said applicant; and
      (4)   Further provided, however, that no more than 25% of the Fire Department membership shall consist of members who live outside the corporate limits of the city.
   (C)   The Fire Chief shall appoint any officers deemed necessary to the operation of the Fire Department at his or her sole discretion, with the advice and consent of City Council.
