§ 154.082 ACTION BY MAYOR AND CITY COUNCIL.
   (A)   At its next regularly scheduled meeting following the submission of the office of Code Enforcement staff’s advisory report, the Mayor and City Council shall, by resolution, either approve or disapprove the PUD final development plan.
   (B)   The Mayor and City Council shall not approve any PUD development plan unless:
      (1)   The developer has posted a performance bond or deposited funds in escrow in an amount the city’s Engineer deems sufficient to guarantee the satisfactory completion of all required improvements;
      (2)   The city’s Attorney has rendered a formal opinion that all legal instruments are satisfactory and lawful; and
      (3)   The proposed planned unit development as evidenced by the final PUD development plan, complies with all applicable codes and ordinances and substantially conforms to the approved preliminary PUD development plan.
