§ 150.085 PERMIT REQUIRED; APPLICATION; ACTION BY THE COUNCIL.
   (A)   (1)   No person shall move any building on, through or over any street, alley, sidewalk or other public way in the city without first securing a permit therefor from the City Clerk.
      (2)   However, the moving of portable buildings, being structures designed to be transported and that are without a foundation, shall be exempt from this subchapter.
   (B)   Application for a permit required by this section shall be made in writing to the City Clerk and shall state the proposed route and the number of days it is intended that the building should occupy any portion of any street, alley, sidewalk or other public place.
   (C)   (1)   Upon filing of an application for a permit required by this section, the City Clerk will refer the application to the Building Inspector, who shall examine the application with reference to whether the proposed building movement complies with the provisions of this chapter and other ordinances of the city relating to buildings.
      (2)   Upon completion of his or her examination of the application and other investigations, if necessary, the Building Inspector shall make his or her recommendations concerning the proposed movement to City Council.
   (D)   (1)   Upon receipt of the Building Inspector’s recommendations relative to the application for a permit required by this section, City Council shall determine whether or not the permit applied for shall be issued.
      (2)   The permit shall not be issued if City Council is of the opinion that the building to be moved, at the new location, would seriously increase the fire risk to surrounding buildings.
